Aspas can't play in GC because he's not a marginalised gender. But if Aspas wanted to he could easily play in tier 2 or tier 3 and Riot wouldn't ban him for doing so because there is no valid reasoning for it.

The REASON Aspas doesn't play in tier 2 or tier 3 is because he has the opportunity to play in tier 1. Now how do you know srN has the opportunity to play in tier 2, even if she could play in tier 2. Would she be able to play on a competitive team?
